In general, if you’re injured in a personal injury accident in the state of Florida, the attorney fees are set forth by the state of Florida. It’s in a contingency fee agreement which means that you don’t pay any fees until a settlement of your case or until you receive some money from your case. The fee is generally 33 1/3% until it gets into litigation. Once suit has to be filed and an answer is given by the defendant, then that fee goes to 40%. That is the general fee for cases with settlements of $1 or less. That fee goes down percentage wise once you get over $1 to $2 and then above $2.
